Terms and Conditions for ExpressAI

These Terms and Conditions (“Terms”) govern your access to and use of ExpressAI, an artificial intelligence chat service operated by ExpressVPN (“ExpressAI,” “ExpressVPN,” “we,” “us,” or “the Company”). By accessing or using ExpressAI (the “Service”), you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

These Terms form a legally binding agreement between you and ExpressVPN and are to be read together with the applicable Privacy Policy, which is incorporated herein by reference.

1. Nature of the Service

ExpressAI is an artificial intelligence–based conversational tool designed to generate automated responses to user inputs. The Service does not provide professional advice of any kind and does not involve human review or intervention as part of its ordinary operation. Outputs generated by the Service are produced automatically based on probabilistic models and may be inaccurate, incomplete, misleading, or inappropriate in certain contexts.

You acknowledge and agree that ExpressAI is a general-purpose AI system and is not designed, intended, or certified to provide legal, medical, financial, psychological, or other regulated professional advice.

2. Eligibility, Subscription Requirement, and User Responsibility
Access to the Service is limited to users who hold a valid, active ExpressVPN subscription in good standing. You acknowledge and agree that ExpressVPN may verify subscription status as a condition of access and may deny, suspend, or terminate access to the Service if your subscription expires, is cancelled, or is suspended for any reason.

You must be at least sixteen (16) years of age, or such higher minimum age as may be required under applicable law, to use the Service. By accessing or using the Service, you represent and warrant that you meet the applicable age requirement, that you hold a valid ExpressVPN subscription, and that you have the legal capacity to enter into these Terms.

You are solely responsible for your use of the Service, for any inputs you submit, and for any actions you take based on outputs generated by the Service.

3. Acceptable Use and Prohibited Conduct

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations, including but not limited to the EU Artificial Intelligence Act, GDPR, UK GDPR, and applicable United States federal and state laws.

Without limitation, you must not use the Service in any manner that involves, promotes, generates, facilitates, or attempts to facilitate any form of sexual content involving minors, including but not limited to depictions, descriptions, or references to minor nudity, sexual acts involving minors, or any content that sexualizes children in any way, whether real or fictional. You must not use the Service in any manner that infringes or violates the rights of children, including rights to dignity, privacy, bodily integrity, or protection from exploitation or harm.

You must not use the Service to generate, disseminate, or rely upon content that infringes or misappropriates the intellectual property rights, privacy rights, personality rights, or other legal rights of any third party, or that is defamatory, abusive, hateful, violent, misleading, or otherwise unlawful.

You must not use the Service to impersonate any person or entity, misrepresent the origin or nature of AI-generated content, engage in surveillance or unlawful profiling, or to attempt to bypass safeguards, reverse engineer, or interfere with the integrity or operation of the Service.

ExpressVPN reserves the right to suspend or terminate access to the Service immediately if it reasonably determines that these Terms have been violated or that continued access would pose legal, security, or reputational risk.

4. Compliance with the EU AI Act and Similar Legislation

ExpressAI is provided as a general-purpose AI system and is not intended to be used as a high-risk AI system within the meaning of the EU Artificial Intelligence Act. You agree not to use the Service in any manner that would classify it as high-risk or prohibited under applicable AI legislation, including but not limited to uses involving biometric identification, social scoring, unlawful profiling, or exploitation of vulnerable persons, including children.

You acknowledge that responsibility for lawful downstream use of AI outputs rests solely with you. ExpressVPN does not assume responsibility for compliance with sector-specific regulations arising from your use of the Service.

5. User Content and Outputs

You retain any rights you may have in the inputs you submit to the Service. Subject to applicable law, ExpressVPN does not claim ownership of user inputs or AI-generated outputs.

You acknowledge and agree that AI-generated outputs may not be unique, may resemble content generated for other users, and do not constitute original or proprietary works attributable solely to you.

You are solely responsible for reviewing, verifying, and validating any output before relying on it or using it for any purpose.

6. No Reliance and Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, ExpressVPN disclaims all warranties, whether express, implied, or statutory, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, non-infringement, and availability.

ExpressVPN does not warrant that the Service will be uninterrupted, error-free, secure, or that outputs will be accurate, lawful, or suitable for any particular purpose. Reliance on any output generated by the Service is at your sole risk.

7. Limitation of Liability

To the maximum extent permitted by applicable law, ExpressVPN shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to your use of or inability to use the Service, including damages resulting from reliance on AI-generated outputs or loss of access due to subscription status.

Nothing in these Terms shall exclude or limit liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or willful misconduct.

8. Indemnification
You agree to indemnify, defend, and hold harmless ExpressVPN and its affiliates from and against any claims, losses, liabilities, damages, and expenses arising out of your use of the Service, your violation of these Terms, or your infringement of any law or third-party rights.

9. Suspension and Termination

ExpressVPN may suspend or terminate your access to the Service at any time, with or without notice, including where your ExpressVPN subscription is no longer valid, where required by law, or where your conduct violates these Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the British Virgin Island without prejudice to mandatory consumer protection laws applicable in your jurisdiction of residence.

11. Modifications to the Terms

ExpressVPN reserves the right to modify these Terms within the limits of applicable law. Continued use of the Service following the effective date of revised Terms constitutes acceptance of the updated Terms.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
